Making An Application

If you have been convicted of a crime in Scotland and you believe you have suffered a miscarriage of justice, you can access our service by completing an application form.

The Scottish Criminal Cases Review Commission reviews cases of alleged miscarriage of justice.

The Commission usually deals with cases in which the convicted person has already appealed. Recently, the Commission has had more people applying to it before they have appealed. We will be producing additional guidance on the appeals process, including information on key contacts at stakeholder organisations who can assist, and this will be available here soon.

What you should know before you apply

Our job is to review your case independently and make a referral if we consider there are grounds for it to be referred. We do not act as your lawyer, but we are independent from the police and the courts.

  • To help us with our review, we will need to get some information about you and your case.
  • You may like to ask a lawyer, family member, friend or someone you trust to help you complete the form.
  • If you would like to use a lawyer, you may be entitled to apply for legal aid.
